How much does an amicable divorce cost?
Court fees of about CHF 400 to 3,000 depending on the canton and your income, plus our fees from CHF 690. A contested divorce with lawyers costs considerably more.
How long does it take?
Usually 3 to 6 months for a joint application with full agreement; often more than a year for a contested divorce.
Do I need a lawyer?
Not for a joint application: the spouses file it themselves. For a contested divorce, in practice yes: we refer you to our partner lawyer.
Can we divorce without being separated?
Yes, for a joint application no period of separation is required. For a unilateral application, you generally need to have lived apart for 2 years.
What happens to my B permit after divorce?
If you obtained it through marriage, it can in principle be renewed after 3 years of marriage if you are well integrated, or for serious personal reasons. Have your situation checked before you divorce.
How is the 2nd pillar split?
LPP pension assets built up during the marriage are in principle split in half.
I divorced abroad. Is it valid in Switzerland?
Generally yes, but the divorce must be recognised and entered in the Swiss register. This is essential if you want to remarry in Switzerland.
Is my Swiss divorce valid in my home country?
Not automatically. Depending on the country, it needs to be registered or recognised by a court, with an apostilled and translated judgment.
Can I go back to my former name?
Yes, at any time, with a simple declaration at the civil registry office.
