Terms and conditions

1. Scope

These terms apply to ABC Office services ordered on MySwissDivorce.ch: file check, preparation of divorce files by joint application, recognition of foreign divorces, procedures for abroad and after the divorce, ordering of documents, apostilles and translations.

2. Nature of the service

ABC Office gathers the documents, sets out the spouses' agreement on the official forms and supports the client with the administrative side. ABC Office is not a law firm: it does not represent the client before the courts, does not provide legal advice and does not guarantee the outcome of any proceedings. The spouses file their application themselves. The content of the agreement is for the spouses alone to decide. The review by the partner lawyer and any advice they give are the subject of a direct relationship between the client and the lawyer.

3. Prices

The prices shown are fees in Swiss francs, per couple for divorce packages. Court fees, official charges, documents, apostilles and postage are borne by the client, paid directly or advanced by ABC Office and passed on at cost. The amount paid for the file check is deducted from a package ordered within 6 months.

4. Payment

Services ordered online are payable when ordering, by card or TWINT via Stripe. Advanced costs are invoiced separately and payable within 30 days.

5. Timescales

The file check report is delivered within 48 working hours of receiving all the information requested. The timescales of Swiss and foreign courts and authorities do not depend on ABC Office.

6. Cancellation and refunds

The client may cancel an order as long as work has not started: the amount paid is then refunded. Once work has started, services performed and costs incurred remain payable. The file check is no longer refundable once the report has been delivered. If the spouses decide not to divorce, work already carried out remains payable.

7. Client obligations and confidentiality

The client provides complete and accurate information. ABC Office treats all information confidentially and is not responsible for the consequences of false or incomplete information.

8. Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is the registered office of ABC Office, subject to mandatory places of jurisdiction in favour of consumers.
