Divorcing in Switzerland when the marriage or a spouse is abroad
Did you marry in another country, or does one of you live abroad? Divorce is often possible in Switzerland, but the file needs foreign documents in good order.
When do the Swiss courts have jurisdiction?
In principle, the court where the respondent spouse lives, or the court where the applicant lives if they have lived in Switzerland for at least one year or are Swiss. For a joint application, the court where either spouse lives. Swiss law generally applies. Your situation is checked in the file check.
Foreign documents
The court asks for the foreign marriage certificate and, if there are children, their birth certificates. These documents often have to be less than 6 months old, apostilled and translated into French. We order them in your country and translate them ourselves.
An agreement in your language
The proceedings are conducted in French. In this package, we translate the agreement into your language so you understand exactly what you are signing.
And in your home country?
A Swiss divorce is not automatically registered in your country. Depending on the country, a simple registration is enough or a recognition procedure is needed: see Swiss divorce abroad and the rules by country.
Our package
CHF 1’290: the complete amicable divorce file (with or without children), coordination of foreign certificates, apostilles and translations for the court, and translation of the agreement into your language. Certificate orders are charged individually.
